A trade mark is a sign which can distinguish your goods and services from those of your competitors. It must be distinctive for the goods and services you provide allowing consumers to distinguish between competitors. Common trade marks include ‘ASDA’, the golden arches of Mc Donalds and nearly all company logos are registered trade marks.

Not only do trade marks help customers to distinguish products and services offered by different businesses it also allows businesses to build goodwill and establish a brand which in turn can help businesses expand.

If someone attempts to register a trade mark which is similar or not distinctive from yours, you can object to the trade mark being registered. If the company were to continue using the similar trade mark, an action can be taken against them for trade mark infringement or passing off.
