Selling or buying a house is not all about the money. There are laws that need to be followed for the house to moved from one owner to the next. Even if you’re not a first-time buyer or seller, the process can be complex and confusing. In these simple steps, our Conveyancing Solicitors in Leicester can help you buy or sell your next house.
Step 1 – Initial instructions from you (start)
For the process to kick off, you need to get in touch with us. We will ask you to provide us with your form of identification and fill out the initial paperwork. If you would like any searches done, we will ask you to send us the funds for that.
Step 2 – Receive draft contract
The seller’s solicitor will send us a draft contract which will include the official copies, the property forms and duplicates of any other relevant documents for the property you’re buying.
Step 3 – Searches and investigation of title
In this step, our Conveyancing Solicitors in Leicester will conduct the searches you had requested and also verify all the documents attached to the draft contract. In case we have any questions, we will forward them to the seller’s solicitor. The process might be lengthy based on the number of questions that we will raise.
Step 4 – Report
After we have all the answers to the questions and the results of the search, we will assemble a report which will include your mortgage offer and the completion statement since we also handle the financial aspect of the transaction.
Step 5 – Signing
If you find all the paperwork to be in order and are satisfied with the answers, the next step is to sign the contract and all the parties will also agree on a completion date. To facilitate the next step in the process, you will need to send us the agreed deposit of the house.
Step 6 – Exchange of contracts
Exchanging contracts means that the terms of the contract and the completion date are legally binding. We will send the deposit to the seller and ask your lender to pay the mortgage advance. On your end, you should ensure that any monies owed to us are cleared at least one working day before the completion date.
Step 7 – Completion of Conveyancing process
On the completion date, the keys will be left with the estate agent after we send the money to the seller’s solicitor. After they confirm receiving it, the key will be released to you.
Step 1 – Initial instructions from you (start)
Because the process of selling a house is more intricate, we will need to discuss the details of the transaction and the property and take notes. This will allows us to start the process. We will ask you to fill out the initial paperwork and also the protocol forms which shed more light on the property you’re selling. You will also be required to provide your form of identity and send us funds for any office copy entries if necessary.
Step 2 – Contact with your mortgage lender
In order to apply for the current title deed and obtain a statement showing how much mortgage is yet to be paid, our friendly Conveyancing Solicitors in Leicester will contact your mortgage lender.
Step 3 – Obtain documents from the Land Registry
We will proceed to obtain electronic deeds at a cost of £12.00 (payable by you) from the Lands Registry.
Step 4 – Preparation of draft contract
From the information and documents collected, we will prepare the draft contract and then send it to the buyer’s Conveyancing Solicitors in Leicester along with the official copies, and protocol forms and any other relevant documents and then wait for them to get back to us.
Step 5 – Enquiries raised by buyer’s solicitor
The buyer’s solicitors will go through the documents we have sent them and review the contract. If there are any questions, they will forward them to us and we will forward them to you for answers.
Step 6 – Agree on a completion date
If the buyer is happy with the answers you have offered, signing the paperwork will be the next step. All the parties will also agree on a completion date after which the buyer will send their solicitor the deposit to organise for the next step.
Step 7 – Exchange of contracts
This is the step that makes the transaction and the completion date legally binding. After the exchange, the deposit is forwarded to us and we proceed to request for a final redemption statement from your lender.
Step 8 – Conveyancing process for selling a house (finish)
On the moving day, the buyer’s solicitor will send the full balance to us and you will be asked to leave the keys with the estate agent. They will only be released to the new owner once we receive the funds. The existing mortgage will be repaid and any other fees regarding the sale cleared. The balance that remains will be sent to you. If you are looking for Conveyancing in Leicester, get in touch with EHL today!
