Conveyancing process for buying a house

Step 1 – Initiate

When buying a house, the process will be started by you getting in touch with us. We will need you to provide us with your form of identity and fill out the initial paperwork. If you would like any searches done, we will also ask that you send us the funds for the searches.

Step 2 – Receive draft contract

The seller’s solicitors will draft a contract and send it to us. With it will be the official copies, property forms and duplicates of any other documents that are essential to the process.

Step 3 – Searches and investigation of title

We will investigate the title and other documents enclosed in the draft contract. If we have any questions, we will address them to the seller’s solicitors for answers. In this step, we will also conduct the searches if you had requested any.

Step 4 – Report

From the results of the search and the answers we receive for all the queries raised, we will put together a report which will include your mortgage offer. Since we cater to the financial aspect of the transaction, we will also include a completion statement showing the total amount you should pay.

Step 5 – Signing

A date for signing will be set if you’re happy with the response to the enquiries. You will also be required to set a completion date together with the other parties in the process. Before the next step is taken, you will be required to send us the deposit of the house which is usually 10% of the buying price.

Step 6 – Exchange of contracts

This is the step that makes the entire transaction and the completion date legally binding. Your lender will also pay the request for your mortgage lender. It is important that you ensure that any monies owed to us are cleared at least one working day before the completion date.

Step 7 – Completion of Conveyancing process

On the completion day, the full purchase price of the house will be sent to the seller’s conveyance solicitor in Northampton and the key left with the estate agent. Once the solicitor confirms the money has been received, the key will be released to you.

Conveyancing process for selling a house

Step 1 – Initial instructions

Selling is a little different. We will need to have a sit-down and gather a couple of details regarding the sale. We will then start the process. First, we will require you to complete the initial paperwork. You will then provide us with your form of identity. The initial paperwork will also contain some protocol forms asking questions about the house you’re selling. We will also request you to send us funds for any copy entries.

Step 2 – Contact with your mortgage lender

To access the current title deeds to the property and find out the balance of the mortgage that is yet to be cleared, we will get in touch with your mortgage lender.

Step 3 – Obtain documents from the Land Registry

We will proceed to obtain electronic deeds at a cost of £12.00 (payable by you) from the Lands Registry.

Step 4 – Preparation of draft contract

We will prepare a draft contract of the sale of the property and send it to the buyer’s solicitors along with the protocol forms, copies of other relevant documents and the official copies. The buyer’s solicitors will then be allowed time to go through all the paperwork.

Step 5 – Enquiries raised by buyer’s solicitor

The buyer’s solicitor has the right to ask questions and seek clarifications on any queries arising. Typically, they will direct those questions to us and we can forward them to you for answers.

Step 6 – Agree on a completion date

After all the questions have been clarified comprehensively, the contracts will be signed and a completion date agreed upon by all the parties. The buyer will then be required to send the deposit to their solicitor to allow for the next step of the process.

Step 7 – Exchange of contracts

Exchanging contracts makes the transaction and the completion date legally binding. Once it has been done, the deposit is transferred to us by the buyer’s solicitor. We then get in touch with your lender to ask for a final redemption statement.

Step 8 – Conveyancing process for selling a house (finish)

The last step which is executed on the moving day is paying the full balance of the sale price from the buyer’s solicitor. Once this has been done, you hand over the keys to the estate agent who hands them over to the buyer after the funds are received by us. From the money paid, the existing mortgage is cleared and any fees incurred in the process deducted. The balance is then sent to you.
