Conveyancing process for buying a house

Step 1 – Initial instructions from you (start)

To get the process started we will ask that you provide us with forms of identity and fill out the initial paperwork. If you would prefer to have the searches done by us, we will also request that you make the funds available.

Step 2 – Receive the draft contract

The seller’s solicitor will complete the draft contract and send it to us. They will also include other documentation like the title deeds and the property forms for our perusal.

Step 3 – Searches and investigation of title

We will complete the searches that are necessary. We will also take the time to go through the title deed and property forms that were sent to us and verify them. If we have any enquiries, we will address them to the seller’s solicitors for answers.

Step 4 – Report

The next step is to create a report for you based on our findings with the searches and the review of the documents that have been sent to us. The report will include your mortgage offer as well as the completion statement that indicates how much you will be required to pay to us.

Step 5 – Signing

Signing is only arranged if you’re comfortable with the information that we have collected and the responses. During the signing, all parties will be required to agree on a completion date and you will also be required to send the deposit of the house to us.

Signing the paperwork does not make anything legally binding. It only allows us to proceed with the process once all parties are in agreement with ease and save time.

Step 6 – Exchange of contracts

Once the contracts have exchanged hands, the completion date and the other terms of the transaction become legally binding. We will then forward the deposit to the seller’s conveyancing solicitor in Slough and request that your mortgage advance is paid by your lender.

Step 7 – Completion of Conveyancing process

All that remains is for us to send the full balance for the property to the seller’s solicitor. Once this is done, the keys will be released to you by the estate agent.

Conveyancing process for selling a house

Step 1 – Initial instructions from you (start)

If you’re looking to sell your house, we will start the process by having a chat to note down the details of the house. With this information, we can start the process. We will then ask you to complete the initial paperwork together with the protocol forms and provide us with forms of identity. In instances where office copy entries are required, we will ask that you make the funds available.

Step 2 – Contact with your mortgage lender

We need to access the current title deed of the property and also a statement that shows the balance on your mortgage. For these documents, we will get in touch with your mortgage lender.

Step 3 – Obtain documents from the Land Registry

The next step is to obtain the most recent electronic deeds from the Land Registry.

Step 4 – Preparation of draft contract

With the information that you have made available to us and the different documents that we have collected, we will create the draft contract and send it to the buyer’s solicitors along with other documents like the property forms and title deeds.

Step 5 – Enquiries raised by buyer’s solicitor

The recipient will need time to go through the paperwork and also conduct any searches that had been requested by their client. If they have any problem or require clarification, they will get in touch with us and we will forward their concerns to you for a response.

Step 6 – Agree on a completion date

The completion date will be settled upon when the buyer is happy with the documents and the responses. During this step, the parties to the transaction will also sign the contract and the buyer will forward the deposit for the house to their conveyancing solicitor in Slough.

Step 7 – Exchange of contracts

After the signing and the agreement on the completion date, the next step is to exchange the contract which then makes the contract legally binding. We will then proceed to request for a statement of final redemption from your lender as the buyer’s solicitor forwards the deposit of the house to us.

Step 8 – Conveyancing process for selling a house (finish)

All that remains is for us to receive the full balance for the property after which we will ask that you leave the keys with the estate agent. We will use the funds to settle your current mortgage and other costs that are related to the sale of the house. The balance will then be sent to you.
