A solicitor is an integral party in the selling or buying of property. As the leading conveyancing solicitors in Stockport, we have a simple and straightforward approach that helps you to buy or sell your home with ease. Our pricing is transparent and the different stages of the process self-explanatory. Here they are.

Conveyancing process for buying a house

Step 1 – Initial instructions from you (start)

To start the process contact us and we will set up a meeting. We will request that you complete the initial paperwork along with your form of identity. We can also conduct searches for you if you need any done. For this we will request you send the funds to facilitate this.

Step 2 – Receive draft contract

A draft contract that has been completed by the seller’s solicitors will be sent to us. Among other things, it will include the property forms, official copies and any other document that is relevant to the property.

Step 3 – Searches and investigation of title

Our conveyancing solicitors in Stockport will carefully review and assess the contract and other documents attached to the contract. We will also carry out the searches requested and make any enquiries pertaining the property. The questions are directed to the seller’s solicitors who then refer them to the seller. Depending on the number of enquiries that have to be made, the process can be quite lengthy.

Step 4 – Report

Based on the responses to the enquiries and the searches, we will put together a report. The report will include your offer on the mortgage. Additionally, we will set the financial aspect of the transaction and offer you a statement showing the amount of money you need to pay.

Step 5 – Signing

If you find all the paperwork to be in order, we will arrange for the signing of the contract. The parties to the transaction will also agree on the date of completion. You will also need to transfer the deposit (usually about 10% of the purchase price) to us.

Step 6 – Exchange of contracts

The deposit sent to us will allow us to organise the exchange of contracts which makes the date of completion and the transaction legally binding. You should ensure that you have any balances payable to us completed one working day before the completion.

Step 7 – Completion of Conveyancing process

The completion will be done on the ‘moving day’. That is when the full purchase price of the house will be sent to the seller’s solicitors. Once they confirm receiving the money, the keys that had been previously left to the estate agent will be passed on to you.

Conveyancing process for selling a house

Step 1 – Initial instructions from you (start)

If you’re looking to sell your house, the process is a little different. To start the process, our conveyancing solicitors in Stockport will need to have a meeting and take some notes on the details of the property. We will also request that you fill out initial paperwork which also contains protocol forms. The forms ask detailed questions about the property that you’re about to sell.

Step 2 – Contact with your mortgage lender

To get a better idea of the property and its state, we will contact your mortgage lender. We will apply to get the current title deeds and a statement of the mortgage payment.

Step 3 – Obtain documents from the Land Registry

The next step is to obtain electronic deeds (Official copies) from the lands registry. This will cost you a small fee of roughly £12.00.

Step 4 – Preparation of draft contract

We will use the documents and information that we have collected thus far along with the details offered by you and use it to draft contract. We will send this to the buyer’s solicitors that include the protocol forms filled earlier, official copies and other documents that are related to the sale of the house. Ideally, this might take some time because the buyer’s solicitors have to review everything.

Step 5 – Enquiries raised by buyer’s solicitor

If there are any questions regarding the property, the buyer’s solicitor will address them to us and we may forward them to you for a response.

Step 6 – Agree on a completion date

Next in the process is to set a date for signing the contracts. The parties in the transaction will also agree on a completion date. Once that is set, the buyer will need to send a deposit to his solicitors to activate the next stage of the process.

Step 7 – Exchange of contracts

To make the transaction and the completion date legally binding, the contracts have to be exchanged. The buyer’s solicitors will then send us the deposit for the house. Consequently, we will request a final redemption statement from your lender.

Step 8 – Conveyancing process for selling a house (finish)

On the completion date, the full purchase price of the house is sent to us. Once that is done, you will be requested to leave the keys to the house to the estate agent. Once we receive the funds, the keys will be passed to the buyer. We will then use the money received to clear the mortgage balance and other costs related to the transaction. The remainder will be sent to you. Begin your house sale and purchase with the help of our conveyancing solicitors in Stockport.
