Conveyancing process for buying a house

Step 1 – Initial instructions from you (start)

You have to give us your instructions for the process to start. After you contact us, we will ask you to fill in the initial paperwork which includes providing us with some form of identity from you. If there are any searches that you would like us to carry out, we will also request that you send us the funds for that.

Step 2 – Receive draft contract

From the solicitors of the seller, we will receive a completed contract along with the official copies of the property and any other documents required for the property.

Step 3 – Searches and investigation of title

We will conduct the searches that you had requested and paid for in step one. We will also review the draft contract received and any attached documents and verify their authenticity. Should we have any questions arising from this process, we will raise them with the seller’s solicitor who will then seek answers from the seller.

Step 4 – Report

After our conveyancing solicitors in Syston have all the answers to the questions we raised and the results of the searches at hand, we will draft a report and send it to you. The report will also include your mortgage offer. We will also set the financial aspect of the transaction and have a statement that highlights the amount you’re expected to pay.

Step 5 – Signing

After all the paperwork is in order and you’re happy with it, we proceed to organise for the papers to be signed and the parties will also agree on a completion date. You will then transfer the deposit the amount depending on the terms to us. This will allow us to organise for the next step of the process.

Step 6 – Exchange of contracts

To make the transaction and the completion date legally binding the contracts are exchanged and the deposited forwarded to the seller’s solicitors. Before the completion, you must ensure that all the funds due from you are with us at least one working day prior to the completion day. We will also request for your mortgage advance to be paid from your lender.

Step 7 – Completion of Conveyancing process

On the ‘moving day,’ the transaction is finalised. This is also called the completion date. During this stage, the full balance of the purchase price is transferred to the buyer’s solicitor and you leave the keys with the estate agent. After we confirm receiving the funds, the keys are then passed to the seller.

Conveyancing process for selling a house

Step 1 – Initial instructions from you (start)

Unlike buying a house, selling one is a little different. Our conveyancing solicitors in Syston will need to sit down and discuss the details of the sale. We will note down any necessary details and then ask you to fill out the initial paperwork and attach your form of identity. You will also need to fill out the protocol forms within the initial paperwork. These help us to answer some of the questions regarding the property. If there are any office copy entries that are required, we will ask you to send us the funds for them.

Step 2 – Contact with your mortgage lender

Before we proceed with the process, we need to know the state of your mortgage and how much is yet to be paid. We also need to apply for the current title deeds. Contacting your mortgage lender will help us get this information and documents.

Step 3 – Obtain documents from the Land Registry

For a small fee, we will obtain current copies of the electronic deeds from the land registry. These are also known as official copies.

Step 4 – Preparation of draft contract

With all the information and paperwork that we have been collecting, we will draft a contract and send it to the buyer’s solicitors. The contract will include the official copies, protocol forms, and any other necessary documents. We will then let the recipient go through the documents.

Step 5 – Enquiries raised by buyer’s solicitor

During the perusal period, the buyer’s solicitor might have questions which they can send to us. Where needed, we will forward the same questions to you for answers.

Step 6 – Agree on a completion date

After we have forwarded your answers to the buyer’s solicitors and they are happy with the response, the parties can then agree on a completion date after the draft contract and other documents have been signed. The buyer will then be required to send the deposit agreed to their solicitor in preparation for the next step.

Step 7 – Exchange of contracts

To make the entire process legal and binding, the signed contract will be exchanged. The buyer’s solicitors will then forward the deposit paid by the buyer to us. On your behalf, we will request your lender for a final redemption statement.

Step 8 – Conveyancing process for selling a house (finish)

When we have received the full balance of the agreed purchase price on the completion day, you’re required to leave the keys with the estate agents. The keys will be only released to the buyer once we confirm receiving the money. We will then clear any mortgage balances and costs related to the transaction and send the rest of the money to you.
