Conveyancing process for buying a house

Step 1 – Initial instructions from you (start)

The process will start with you getting in touch with us and giving us your clear instructions. To make it official, we will ask you to complete some initial paperwork along with forms of identity. We will ask you to make funds available for any searches and initial work that will be carried out.

Step 2 – Receive draft contract

Your seller’s solicitors will complete a draft contract and send this to us. It will include; property forms, official copies (electronic deeds) and copies of any other relevant documentation regarding the property you’re interested in.

Step 3 – Searches and investigation of title

We will review and verify all documents that have been sent to us and conduct the searches that have been requested. Should any issues arise, we will take them up with the seller’s solicitor who can then seek clarification from the seller.

Step 4 – Report

A report will be created on the property after we obtain the search results and we have all the answers to the questions we asked. We will also set out your financial obligations and avail a completion statement indicating the total sum of money you’re to pay.

Step 5 – Signing

If all the paperwork is in order, we can arrange for you to sign. All parties in the transaction must also agree on a completion date. At this point, you will be required to transfer the deposit for the purchase of the house which allows us to arrange the exchange of contracts.

Step 6 – Exchange of contracts

The exchange of contracts makes the transaction and completion legally binding. The seller’s solicitor will then receive the deposit from us after the exchange of the contract and a request for your mortgage advance paid from your lender. We must have the balance from you at least one working day before the completion.

Step 7 – Conveyancing process for buying a house (finish)

The completion will be done on the ‘moving day’. That is when the full purchase price of the house is sent to the seller’s solicitors. Once they confirm that they have received the money, the keys that had been previously left with the estate agent will be passed on to you.

Conveyancing process for selling a house

Step 1 – Initial instructions from you

Selling and buying a house are slightly different. To start the process, we will have a discussion about the sale and we will take note of the important details. We will ask that you complete the initial paperwork and also get a form of identity. The initial paperwork comprises of protocol forms with detailed questions regarding the property you’re selling. If there are any office copy entries needed we will ask you to send us the funds.

Step 2 – Contact your mortgage lender

We will contact your mortgage lender for you current title deeds and request for a statement showing how much you’re yet to pay.

Step 3 – Obtain documents from the Land Registry

We will obtain electronic deeds (official copies) from the land registry.

Step 4 – Preparation of draft contract

We will use the documents and information that we have collected thus far along with the details supplied by you and use it to draft contract. We will send this to the buyer’s solicitors that include the protocol forms, official copies and other documentation that are related to the sale of the house. This might take some time as the buyer’s solicitors have to review everything.

Step 5 – Enquiries raised by the buyer’s solicitors

This window allows the buyer’s solicitor to conduct due diligence. They can carry out other searches requested by the buyer and reviewed the paperwork sent. If they have any questions regarding the property, they may use this opportunity to reach ask them.

Step 6 – Agree on a completion date

If the questions have been answered to the buyer’s satisfaction, the next step is to determine a date when the signing of the papers and the completion will be done. The buyer will then be required to send a deposit of the buying price to their solicitor. This is a signal to us that we need to start arranging for the exchange of the contract.

Step 7 – Exchange of contracts

The transfer of deposit is our signal to start arranging the exchange of contracts. Once this has been done, the completion date and the transaction now become legally binding. We then proceed to request for a final redemption statement from your lender after the buyer’s solicitors have forwarded the deposit paid by the buyer to us.

Step 8 – Conveyancing process for selling a house (finish)

On the completion date, the full purchase price of the house is sent to us. Once that is done, you will be requested to leave the keys to the house to the estate agent. When we receive the funds, the keys will be passed to the buyer. We will then use the money received to clear the mortgage balance and other costs related to the transaction. The remainder will be sent to you.
