You must satisfy the court on one of the following 5 reasons (or grounds) in order to get a divorce:

Adultery: This is voluntary sexual intercourse between consenting parties who are not married to each other, but one of whom, at least is, a married person.

Unreasonable Behaviour: This is when a married person has behaved in such a way that their spouse cannot reasonably be expected to live with them.

Desertion: This is when a married person has deserted their spouse without their consent and the parties have lived apart for two years.

Two Year Separation with Consent This is when a married couple have lived apart for a continuous period of 2 years and both parties consent to the divorce.

Five Year Separation: This is when a married couple have lived apart for a continuous period of at least five years.

Divorce Procedure

Our divorce law experts will begin by lodging a divorce petition with the courts. The respondent (your partner) will then be required to complete an acknowledgement of service, in which they confirm that they have received the petition. Following this, you will be free to apply for a Decree Nisi of divorce and, subsequently, a Decree Absolute – the final decree of divorce.
