Many clients will, at some point, experience disputes with HM Revenue & Customs. Whilst these can often be resolved without HMRC taking litigious action, in some cases it is not possible to reach an agreement with them.
With the introduction of the Tax Tribunal system in 2008/09, the tax Commissioner hearings were replaced with a more formal process which is subject to broadly the same rules as the courts.
Tax disputes are a specialist area, requiring an understanding of both the dispute process and the tax issues. We are able to offer specialist advice in both areas, to provide a full service to our clients.
Our litigation team deals with all procedural matters, whilst our specialist tax team take on the technical issues. Whilst the litigation team look to resolve the dispute, the technical team are on hand to advise on any ways to mitigate the tax exposure going forwards.
We have experience of dealing with a broad range of HMRC disputes, with particular expertise in defending standardised tax “products” and are happy to work alongside your existing advisers or in isolation, whichever is most appropriate.
