Conveyancing process for buying a house

Step 1 – Initiate

You will need to engage us first when you’re ready to buy a house. We will ask that you provide us with your form of identity and that you also fill out the initial paperwork. If there are any searches that you would like us to conduct, kindly avail us with the funds for the searches as well.

Step 2 – Receive draft contract

The seller’s conveyance solicitor in Milton Keynes will send a draft contract to us that includes the electronic deed, the protocol forms, and any other necessary documents.

Step 3 – Searches and investigation of title

In this step, we will start by carrying out any searches that you had requested for. We will also review the contract and verify all the documents that were attached to the contract. Step 4 – Report

Step 5 – Signing

If you find all the paperwork to be in order and are happy with the response from the buyer, we will arrange for the signing of the contract. Step 6 – Exchange of contracts

To make the transaction legally binding, the contracts will be exchanged. We will send the deposit to the seller’s solicitor and request your lender to pay for the mortgage advance.

Step 7 – Completion of Conveyancing process

On the completion day, we will send the balance of the purchase price of the house to the seller’s solicitor. You will receive the key to the house from the estate agent after confirmation of the money having been received.

Conveyancing process for selling a house

Step 1 – Initial instructions

As in buying the house, you will need to get in touch with us first when selling as well. We will have a talk and discuss the details of the transaction. We may also take notes if necessary to help us start the process. You will also be required to complete the initial paperwork and fill out the protocol forms and attach your form of identity. Also, transfer funds for office copy entries if any are needed.

Step 2 – Contact with your mortgage lender

We will need to get in touch with your mortgage lender to provide us with a statement showing how much of the mortgage is yet to be repaid and also provide us with updated electronic deeds to the house you’re selling.

Step 3 – Obtain documents from the Land Registry

We will then obtain the most current electronic deeds (official copies) from the Land Registry at the cost of £12.00 payable by you.

Step 4 – Preparation of draft contract

We will prepare the draft contract and send it to the buyer’s solicitor. In it, we will attach copies of the electronic deeds, the protocol forms, and duplicates of any other relevant paperwork.

Step 5 – Enquiries raised by buyer’s solicitor

The buyer’s conveyancing solicitor in Milton Keynes will need to review the draft contract and verify the documents. If they have any enquiries, they will get in touch with us, and we will refer to you for answers. The process might be lengthy depending on the number of questions that have to be asked.

Step 6 – Agree on a completion date

After we have addressed all the enquiries and the buyer is satisfied, we can arrange for a signing of the contract. During the signing, a completion date will also be settled upon by all the parties in the sale. The buyer will then be required to transfer the deposit to their solicitor to allow us plan for the next step.

Step 7 – Exchange of contracts

The transaction and the completion date will become legally binding when the contracts are exchanged. The deposit will be transferred to us, and we will request for a final redemption statement from your lender.

Step 8 – Conveyancing process for selling a house (finish)

Once we receive the money, the keys will be released to the new owner. We will then proceed to clear your current mortgage balance and other fees related to the sale.
