Fake Wills

BBC’s ‘Fake Britain’ recently reported on the increasing number of fake Wills being drawn up by disinherited or disgruntled family members. The investigative programme reported on a particular case where the son of the deceased faked his fathers Will and subsequently presented it to the bank along with a death certificate in order to obtain release of funds held in an account. The fraud did not come to light until the grandson who stood to benefit from a share in the estate discovered the account had been closed.

With handwritten Will precedents readily available for purchase and an increasing number of on line drafting facilities on the internet it is little wonder the temptation to fake a Will is on the increase.

It is hard to comprehend people are willing to protect their hard earned wealth and possessions with a document purchased across the counter and written by hand simply to avoid professional fees. The programme reiterated the need for a Will to be drawn up by a solicitor or professional person. 

It is important to remember when considering making a Will, solicitors are regulated and required to retain comprehensive notes following a meeting with a client.  In contentious circumstances the practitioner responsible for the drafting of the Will is a material witness and depending on the circumstances would be in a position to provide crucial evidence, if needed.  Without professional advice there is every possibility a home made Will may contain errors or omissions which may lead to difficulties. 

In the case reported by the BBC, those perpetrating the fraud wrote the fake Will by hand and handwriting experts were able to expose the fraud.
