Does your business operate CCTV cameras? If you have considered the implications of monitoring your workforce either covertly or openly, it is important to note you must comply with the ICO CCTV code of practice.

This requires an employer to consider whether it is suitable to install cameras. The data protection act requires sensitive data to be processed I accordance with the act which includes video footage of employees. As such the use and management of CCTV should clearly be included in a data protection policy.

The use of CCTV for the purposes of monitoring staff performance should be clearly explained to staff to avoid claims for constructive unfair dismissal or arguments the footage is not admissible as evidence.
