The History of Trusts

Trusts appear to be complicated structures, but it is useful to understand why they are recognised under English Law in the first place.

As a concept, Trusts date back to the twelfth century and the Crusades.  When a landowner left England to fight in the Crusades, he needed someone to run his estate in his absence, often to pay and receive feudal dues.  To achieve this, he would convey ownership of his lands to a trusted friend, on the understanding that the ownership would be conveyed back on his return.  However, many of those trusted friends were reluctant to hand the property back, and the current Trust principles were devised to recognise that the legal title could be held by one person, but the benefit of that property was for the enjoyment of another.

In simple terms, a trust has a Trustee who owns the legal title to property, and a Beneficiary, for whom the benefit of the property is held.  This relationship is governed by English Law (primarily the Trustee Act 1925) and also by the Trust Deed itself, which sets out the rules by which the Trust will be administered.
