Trust Types

Trusts are very flexible structures, but the most widely used applications are:

  1. Asset Protection Trusts: Using Trusts to preserve wealth for future generations, to direct how this will be passed on and to alleviate a concern that potential creditors could claim on them in the future, although care must be taken in all cases to ensure that no transfers of property into trust are made in such a way as to prejudice any known creditor claims.
  2. Will Trusts: in the past, married couples would write assets into trust in order to access their inheritance tax allowance.  Whilst no longer required from a tax perspective, this type of trust ensures that the Testator can decide how assets will be passed on in the future (there is often a concern that the surviving spouse could re-marry and divert wealth away from the children).
  3. Trusts for children: To manage wealth or assets that may have been passed to children
  4. Trusts for vulnerable beneficiaries: These could be for children, or for beneficiaries with disability.
  5. Employee Benefit Trusts: These are usually set up by companies for their employees.
  6. Excluded Property Trusts: For non-UK domiciliary clients, these are used to hold offshore assets outside the scope of UK inheritance tax.

Trusts can be used to achieve most objectives – they are very flexible with a skilled draftsman.
