When proceedings are issued, the courts will decide which ‘track’ the case will be allocated to. For claims under £10,000.00 the court automatically allocates them to the small claims track. This is a track for straightforward and relatively low value claims.
The benefit of the small claims track is that less work is involved in preparing the case for a final hearing. Once a defence has been filed and the court has decided to allocate the claim to the small claims track, the next step is for the parties to file the evidence they intend to rely upon up to 7 days prior to the hearing.
The general rule in claims is the losing party will pay the winning party’s costs. However in small claims, the disadvantage to claimants is that they are only able to claim a low amount of fixed costs toward their claim if they are successful.
