Conveyancing process for buying a house

Step 1 – Initial instructions from you (start)

The process of buying the house will start when we receive the initial instructions from you. We will request that you complete the initial paperwork and provide us with forms of identity and ask if you would like any searches conducted, we will also ask that you make the funds available for this.

Step 2 – Receive the draft contract

The seller’s solicitor will send us a copy of the draft contract along with other important documentation like the electronic deeds and property forms and duplicates of other documents that are essential to the transaction.

Step 3 – Searches and investigation of the title

In this step, if you had asked to conduct any searches or if any searches were necessary, we will conduct them. We will also review the paperwork that was sent to us by the seller’s conveyancing solicitor in Harrow. If we have any questions, we will refer them to the seller’s solicitor for answers.

Step 4 – Report

With the results of the search and the answers obtained from the seller’s solicitors, we will put together a report and send it to you. We will also include your mortgage offer and the completion statement in the report.

Step 5 – Signing

If all the paperwork is in order, we can make arrangements for the signing and make proposals for the completion date. You will be requested to forward the agreed deposit to us to arrange for the next step.

Signing the contract does not compel you to any agreement with us. It is a simple time-saving measure to expedite the process once the parties are in agreement, it is not legally binding.

Step 6 – Exchange of contracts

For the transaction to be legally binding the contracts need to exchange hands. The deposit is then transferred to the seller’s conveyancing solicitor in Harrow’s account and we request for your mortgage advance to be paid. We will also request that you clear all the balances owed to us one working day prior to the completion day.

Step 7 – Conveyancing process for buying a house (finish)

On the moving day, the full purchase price of the house is sent to the seller’s solicitor. The keys will be left with the estate agent and released to you once the seller’s solicitor confirms receiving the money.

Conveyancing process for selling a house

Step 1 – Initial instructions from you (start)

Selling your house is a little different. First, we will have a talk on the details of the sale and take down notes to help start the process. We will ask you complete the initial paperwork which will also include the protocol forms that shed light on the house that you’re selling. You will also be requested to provide us with forms of identity and funds for office copy entries in case any will be required.

Step 2 – Contact your mortgage lender

We will need to request a statement that shows how much of your mortgage is left to pay and also the current title deeds from your mortgage lender.

Step 3 – Obtain documents from the land registry

We will need to access up to date copies of the electronic deeds from the Land Registry.

Step 4 – Preparation of draft contract

We will use the information and documents that we have collected to prepare the draft contract for the sale of your house. We will then send this draft contract to the buyer’s conveyancing solicitor in Harrow along with copies of the electronic deeds, protocol forms and other vital documents.

Step 5 – Enquiries raised by the buyer’s solicitor

The buyer’s solicitor will need some time to go through the paperwork that we have just sent and if they have any questions, they will forward them to us and we will forward them to you for answers. This process might take up to a week depending on the number of enquiries that have to be made.

Step 6 – Agree on a completion date

If the buyer is happy with the answers that have been provided, we will arrange for the signing of the paperwork and all the parties will agree on the completion date of the transaction. The buyer will then be expected to forward the deposit of the house to their solicitor for the next step.

Step 7 – Exchange of contracts

Once the exchange of contracts has taken place, the transaction becomes legally binding. The deposit amount is forwarded to us by the buyer’s solicitor and we request a final redemption statement from your lender.

Step 8 – Conveyancing process for selling a house (finish)

On the moving day, we will receive the full amount of the sale price from the buyer and request that you leave the keys to the house with the estate agent. We will then use the money that we have received to settle your current mortgage and any fees owed to us and send the balance to you.
