Conveyancing process for buying a house

Step 1 – Initial instructions from you

When buying a house, the process is started when you get in touch with us. To get more details, we will ask you to fill out some initial paperwork and also provide us with forms of identity. If you would like to have some searches conducted, we will also ask that you make funds available to facilitate these.

Step 2 – Receive draft contract

The seller’s solicitors will complete a draft contract and then send it to us. Amongst other things, the contract will include property forms, duplicates of any relevant documentation regarding the property and official copies (electronic deeds).

Step 3 – Search and investigation of title

Depending on the questions that might need clarification and answers, this step could take some time. It starts with us investigating the documents that have been sent and verifying them. If there are any questions we direct these to the seller’s solicitors. At this stage, we will also carry out the searches that you have requested.

Step 4 – Report

We will put together a report on the property once we have all the answers. The report will include your mortgage offer as well as the completion statement which shows the total amount you’re expected to pay.

Step 5 – Signing

If you’re satisfied with the paperwork, the next step is to arrange the signing and setting of a completion date. The completion date has to be agreed upon by all the parties in the transaction. You will then transfer the deposit to us. The last part of this step is the exchange of contracts which we will do after the deposit has been transferred.

Step 6 – Exchange of contracts

The exchange of the contracts makes the completion date and the transaction legally binding. Once this is done, we forward the deposit to the seller’s solicitors, and we request your lender for a mortgage advance. In your part, you should ensure that any further monies owed to us are cleared at least one working day before the completion date.

Step 7 – Completion of Conveyancing process

The last step is pretty simple. The full purchase price of the house is transferred to the seller’s solicitor and the seller leaves the key with the estate agent. After the funds are received, the key is released to you.

Step 1 – Initial instructions from you

The process of selling a house can be confusing but not to worry, we are here to help. First, we will discuss the sale of the property and take notes on any necessary information. With these, we can get the process started. You will then be required to provide us with your form of identity, fill out the initial paperwork and also complete the protocol forms. If there are any office copy entries required, we will request that you deposit the funds with us.

Step 2 – Contact with your mortgage lender

We will need the most recent title deeds to the property. We will also need to request your mortgage lender for a statement showing how much of the current mortgage is yet to be cleared.

Step 3 – Obtain documents from the Land Registry

It is essential that we obtain up to date copies of the electronic deeds from the Land Registry.

Step 4 – Preparation of draft contract

We will prepare the draft contract for the sale of the property. This is then sent to the buyer’s solicitors along with any other relevant copies that include protocol forms and official copies. The buyer’s solicitor has to go through all the documentation and verify the contract paperwork.

Step 5 – Enquiries raised by buyer’s solicitor

To conduct the searches requested by the buyer and review the paperwork that we have sent, the buyer’s solicitor will need some time. If during the process there are any questions, they will forward the questions to us and we will seek answers from you.

Step 6 – Agree on a completion date

At this stage, the signing and completion of the contract can be arranged if the buyer is happy with the responses. After all parties agree on a completion date, the buyer will send the agreed deposit of the property to their solicitor which directs us to prepare for the next step.

Step 7 – Exchange of contracts

Once the contracts exchange hands, the completion date and the entire transaction becomes legally binding. The buyer’s solicitor then forwards us the deposit and we send a request to your sender for a final redemption statement.

Step 8 – Conveyancing process for selling a house

When we have received the full balance of sale price from the buyer’s solicitor, you will be required to leave the keys with the estate agent who will pass them to the buyer once the funds have been received. This is done on the much awaited ‘moving day’ when the conveyancing process is completed. All balances including your mortgage balance will be repaid and the remaining balance sent to you.
