Do Intellectual Property Rights override Political Beliefs?

April 3, 2017

Whilst the position generally is of course a great debate, a recent UK legal battle suggests the answer is yes.
A London based coffee kiosk named ‘Star Box Coffee’ was recently forced to change its name following a David and Goliath battle with Starbucks Coffee. Starbucks pursued Star Box Coffee claiming its trading name is “technically an infringement of trademark rights” and the similarities in its name could “weaken” its global brand.
However, owner of Star Box Coffee Nasser Kamali claims he is a strong believer in Marxism and the red star logo that is branded on his kiosk simply reflects his beliefs. Mr Kamali displays a Karl Marx mug and red star in his stand and claims he is literally in a box and it is his red star box. Mr Kamali was imprisoned in his home country of Iran for his political views and later fled the country in 1990. To widen his research, he conducted his own socialist pilgrimage visiting 32 countries around the world, to delve into social beliefs and alternatives to capitalism.
Despite his views, Mr Kamali has removed the word ‘star’ from his branding, but on principle rejected a £300.00 goodwill gesture from Starbucks. He claims that his prospects of beating Starbucks in Court were low due to the level of reinforcement Starbucks has but asserts Starbucks stance reaffirms the power of capitalism.
